Scott Dondershine is hosting a cyber security seminar regarding threats to businesses. (1) IT: Protect your firm from insider threats as well as outside bad actors. People can be your biggest risk – make sure your staff is trained and that your infrastructure is set up to mitigate risk.

(2) Banking: Know the types of fraud and understand ways to prevent them by using your financial institution for guidance.

(3) Cyber Insurance: There are potentially enormous costs associated with even a small cyber breach or attack. How will your business pay for forensic examination, regulatory notifications, credit monitoring, data recovery and many other associated costs?

Bid Protests: What to Do and How to Avoid Mistakes

Ken will be teaching a class for the Procurement Technical Assistance Program at the George Mason University Enterprise Center on “Bid Protests: What to Do and How to Avoid Mistakes” on January 21, 2016 from 9:00am-1:00pm.

This course will address topics of interest to government contractor personnel. It is designed for company executives, contracting professionals, small government contracting business owners, lawyers and anyone else who wants to learn about the federal procurement system protest process. The program will focus particularly on issues of importance to businesses who may be unfamiliar with the protest process and want to understand the limits, relevancy and benefits of the process, as well as the practical alternatives to bid protests. The course will concentrate on GAO bid protests, the forum commonly chosen by protestors, but will also address protests before U.S. Court of Federal Claims (COFC) and individual agencies. In addition, the program will also explore the size protest process before the Small Business Administration (SBA).

Specific topics will include:

  • Comparing the myths and realities of the protest process, including discussing how often the agency really prevails and how often the agency takes “corrective action” in response to a protest
  • How to identify and distinguish potentially valid grounds of protest and weak or speculative grounds
  • Review GAO decisions on important topics such as Organizational Conflicts of Interest
  • Learning about pre-award actions to consider in order to avoid or minimize the potential for protests
  • Learning how to effectively use the debriefing process to defuse disagreements with your customer and avoid unnecessary protests
  • Understanding the strict timeliness requirements that apply in the protest process Understanding the benefits and disadvantages of bringing a protest to the GAO vs. the other forums
  • How to prepare a protest and a request for production of documents
  • Understanding what to expect from an agency in its report in response to a protest and how the protest document discovery rules deal with the handling of confidential source selection or proprietary information
  • Understanding the broad deference and limits on discretion afforded to procurement officials in selecting the awardees
  • Understanding when you can still “win” a protest or, at least, achieve meaningful agency “corrective action” and when you are probably going to lose
